Regulatory Advice

Quality advice around regulations and the interaction with subdivision plans, clauses appropriate for Sale and Purchase agreements, water allocation transfers as they relate to land holdings and the legal satisfaction of Regional Council requirements.

Land Use Planning

Topography affects land and water use needs and differs from property to property.

With current land surveying and aerial mapping databases, Land & Water can provide a comprehensive report on the land allowing you to make informed decisions around the management and future planning of your property.

This includes the identification and review of easement provisions, water supply agreements, land use considerations, assets and impediments.

Deemed Water Permits

The expiry of Deemed Water Permits on 1 October 2021 needs attention now. Mining Privileges may confer rights over land not owned by the Consent Holder and should be converted to Section 417 Certificates under s 417 of the Resource Management Act 1991 (RMA).

Anyone wishing to continue taking water for agricultural purposes must apply to Otago Regional Council for a new resource consent.
Land & Water offers a complete service for applying for the continued use of water or land access and this needs to occur well before the expiry date of your current water permit.

Land & Water takes the stress out of resource consent process, so you can get on with doing business.
